    En este informe se brinda una mejora en el seguimiento y facturación de kits entregados en los programas apoyados por las marcas Ensure y Glucerna de Abbott Laboratories de Colombia S.A.S, empresa que se encuentra en el sector farmacéutico. Se identificó de manera clara que no se estaba realizando un control frente a la entrega de los kits, por lo cual se decidió realizar un formato en el que se incluyera información de manera detallada para realizar un seguimiento de los kits mencionados, a su vez comprender el alcance que tuvo la implementación en estas actividades y realizar una verificación de cuáles fueron las instituciones en las que se estaban entregando estos. Se encontró que los datos consolidados en dicho formato no eran acordes con el número de materiales enviados para estas actividades durante el ciclo, observando que los productos no eran del todo aprovechados teniendo en cuenta el objetivo con el que habían sido enviado, dado a que no se tenía en cuenta de manera previa el tipo de programa que los representantes manejaban y esto se debía a que no se estaba facturando de manera adecuada el material. A partir de allí, se procede a realizar una verificación y corrección del proceso de facturación para este tipo de materiales; sin embargo, teniendo en cuenta la situación sanitaria del momento, fue imposible llevar dicha corrección al campo práctico, debido a que se suspendieron las actividades de la fuerza de ventas y las prioridades del area tambien cambiaron.This report provides an improvement in the monitoring and billing of kits delivered in the programs supported by the Ensure and Glucerna brands of Abbott Laboratories de Colombia S.A.S, a company that is in the pharmaceutical sector. It was clearly identified that a control was not being carried out against the delivery of the kits, for which it was decided to make a format in which detailed information was included to track the mentioned kits, in turn understand the scope of the implementation of these activities and to verify which were the institutions in which they were being delivered. It was found that the consolidated data in this format were not consistent with the number of materials sent for these activities during the cycle, noting that the products were not fully used taking into account the purpose for which they had been sent, since they were not The type of program that the representatives handled was previously taken into account and this was due to the fact that the material was not being invoiced properly. Samotné analýze předchází teoretická část zaměřena na tradiční složky komunikačního mixu. V praktické části jsou následně aplikovány teoretické poznatky na vybraném příkladu společnosti.     Plaintiff-appellee Barr Laboratories, Inc. ( Barr ) and defendant-appellant Abbott Laboratories ( Abbott ) are manufacturers of pharmaceutical products. Among those products is a broad spectrum antibiotic drug produced by both parties. Although its patent rights in the drug have expired, Abbott continues to market the product under a brand name. Barr competes with Abbott by distributing the antibiotic under a generic name. Accusing Abbott of extending its patent monopoly by misrepresenting to state agencies and others the quality of the generic version of the drug, Barr commenced the action at bar in the United States District Court for the Southern District of New York. Alleged in the complaint are claims predicated on violations of the Sherman and Lanham Acts as well as pendent state tort claims. Following some pre-trial proceedings, the parties entered into and filed a stipulation dismissing the action with prejudice. Thereafter, Barr filed a similar action against Abbott in the District Court of New Jersey. There followed an application by Abbott in the Southern District for the imposition of Rule 11 sanctions upon Barr. Judge Duffy, to whom the case originally had been assigned, denied the application for lack of jurisdiction. While we are not prepared to say that a district court is totally without authority to impose sanctions after a stipulated dismissal, we hold that Abbott\u27s application properly was denied under the circumstances presented here
