    La responsabilità nella assistenza alla gravidanza

    Riassunto L’autore affronta il tema della responsabilità professionale per danni ascrivibili ad inadeguata assistenza della gravidanza. Vengono esposti i dati emergenti dall’esame della casistica afferente all’osservatorio dell’Azienda Ospedaliera – Università di Padova. Da questo esame si evince che le contestazioni sono per la maggior parte attribuibili a ritardo o mancanza di diagnosi prenatale di malformazioni fetali. Viene riportato un caso in cui la richiesta di risarcimento deriva dall’ipotesi che il medico abbia prescritto un ricovero ospedaliero non necessario con induzione di un parto pre-termine. Nell’articolo vengono altresì illustrate alcune sentenze di particolare interesse della Corte di Cassazione sul tema. L’autore analizza le motivazione che i giudici hanno espresso nell’affermare l’esistenza della relazione causale tra danno lamento (nascita di figlio non voluto) e condotta assistenziale. Summarry The author discusses the topic of medical liability for damages due to inappropriate pregnancy assitance. The author shows data from the examination of the cases arriving to the Observatory of the University Hospital of Padua. From this study it emerges that, for the great majority, disputes are attributable to a delay or lack of prenatal diagnosis of fetal malformations. The author here reports a case where the request of compensation comes out from the hypothesis that the physician had prescribed an unnecessary hospital admission followed by a preterm delivery. The paper also deals with some sentences of the Italian Court of particular interest for this issue. Finally, the Author analyzes the motivation(s) the judges have expressed afferming the existence ot causal relation between the alleged damage (birth of an undesired son) and medical behaviour

    La sindrome di Munchausen by proxy

    Why publishing a Focus on Münchausen by proxy syndrome? Simply because the physician is a leading actor of the disease: without the physician Münchausen by proxy syndrome (MPS) would not exist. Besides, only the physician can break the chain of events that characterizes it. Children are the victims of MPS in most cases, thus the paediatrician most frequently meets the syndrome in their clinical practice. Therefore, knowing the typical features of the syndrome is essential. Specific clues of MPS exist. The diagnosis requires a long iter and a multispecialist approach. The paediatrician suspecting MPS may be aided by a neuropsychiatrist and a forensic scientist, but they need to know by themselves when and how to inform competent authorities. MPS is a kind of child abuse, therefore child protection must be the first aim. MPS exists and cannot be ignored. The aim of this Focus is to help physicians tackling it
