No full textPrison as an institution is the center of Valeria Verdolini's The Rejected Institution (2022), which is commented on in this article. An important contribution that explores issues that the prison literature has never dug as much as necessary. The author, sharing and appreciating Verdolini's effort, recommends preserving the heuristic capacity of the comprehensive notion of "total institution", proposed at the time by E. Goffman, and further investigating the passive form of the adjective associated by Verdolini to penitentiary institution: if it is "rejected", it means that it has been rejected, by an external agent, who is responsible for the stigma that from the inmate population pours itself on the institution that look after it
L'uso populista del diritto e della giustizia penale
No full textThe penal populism is always most frequently mentioned in the analysis of criminalization
processes and political consensus dynamics. Starting from the most widespread
interpretations of contemporary populist phenomena, the article proposes a redefinition
of penal populism and an interpretative grid of the various populist uses of criminal law
and justice. In this way it is possible to widen the field of observation of the populist use
of criminal law and justice beyond that of populist leaders and movements and to see
the contribution that other political and institutional subjects also give it. Considering
that the populist use of criminal law and justice puts at risk the fundamental principles
of liberal criminal law, the author stresses the need for an ecological change that simultaneously
frees politics from populist use of criminal law and criminal justice from the
political aim of seeking consensus
