A uberização do trabalho sob a ótica internacional: a negligência da Organização Mundial do Comércio e da Organização Internacional do Trabalho
This work aims to study the possibility of regulating the activities of application companies, which configured the process of "uberization of work", in which the rise of digital platforms, whose main objective is to connect service providers and demanding customers, has solidified the outsourcing of work and deepened labor exploitation. Therefore, it is assumed that social dumping, characterized by the removal of labor rights to increase the entrepreneur's profit margin, is a primordial characteristic of the phenomenon. In this way, a historical analysis of the debate on labor issues within the World Trade Organization (WTO) and the International Labor Organization (ILO) will be carried out, in which this position was defined and granted to the latter. Therefore, following the hypothetical-deductive method of approach and the descriptive-explanatory method of objective analysis, and using bibliographic and documental procedural techniques, it is concluded that cooperation between them would be the best way to combat working conditions platform workers, insofar as the WTO, on the one hand, could legitimize economic sanctions to application companies that violate minimum labor rights and, on the other, the ILO could exercise its regulation in the domesticity of countries through the elaboration of a Convention or a Recommendation
ENTRE A OMC E A OIT: A QUEM COMPETE A REGULAMENTAÇÃO DAS PLATAFORMAS DIGITAIS DE TRABALHO À NÍVEL GLOBAL?
Contextualization of the theme: There is a current growing international negligence regarding the precariousness of work promoted by the proliferation of app companies, which cause the emergence of a new labor format that disregards many of traditional individual rights. In this scope, there is a need to think about common standards that safeguard workers in this 4.0 environment, being the World Trade Organization (WTO) and the International Labor Organization (ILO) potential locus of protection.
Objectives: The present research aims to analyze the (lack of) regulation at a global level of the growing phenomenon of uberization of work, highlighting, above all, the potential role of the WTO and the ILO for the development of labor protection.
Methodology: We follow the deductive method of approach for the development of the text; the historical and descriptive-explanatory methods of analysis of objectives; and the bibliographic and documental techniques of research procedure, selected from the keywords and using a qualitative criterion.
Results: We conclude that cooperation between them would be the best way to combat working conditions platform workers, insofar as the WTO, on the one hand, could legitimize economic sanctions to application companies that violate minimum labor rights and, on the other, the ILO could exercise its regulation in the domesticity of countries through the elaboration of a Convention or a Recommendation.Contextualización del tema: Actualmente, existe una creciente negligencia internacional respecto a la precariedad del trabajo promovida por la proliferación de empresas de aplicación, que provocan el surgimiento de un nuevo formato de trabajo que desconoce muchos de los derechos tradicionales de las personas. En este ámbito, es necesario pensar en estándares comunes que resguarden a los trabajadores en este entorno 4.0, destacándose como posibles locus protectivos la Organización Mundial del Comercio (OMC) y la Organización Internacional del Trabajo (OIT).
Objetivos: La presente investigación tiene como objetivo analizar la (falta de) regulación a nivel global del creciente fenómeno de la uberización del trabajo, destacando, sobre todo, el papel potencial de la OMC y la OIT para el desarrollo de la protección de los trabajadores. Metodología: Se sigue el método de enfoque deductivo para el desarrollo del texto; los métodos histórico y descriptivo-explicativo de análisis de objetivos; y las técnicas bibliográficas y documentales de procedimiento de investigación, seleccionadas a partir de las palabras-clave y a través del empleo de criterios cualitativos.
Resultados: Se concluye que la cooperación entre estas organizaciones sería la mejor manera de combatir las condiciones laborales de los trabajadores de plataforma, en la medida en que la OMC, por un lado, podría legitimar sanciones económicas para las empresas de aplicación que violen derechos laborales mínimos y, por otro lado, la OIT podría ejercer su regulación en el ámbito doméstico de los países a través de la elaboración de un Convenio o Recomendación.Contextualização do tema: Atualmente, existe uma crescente negligência internacional no que tange a precarização laboral promovida pela proliferação das empresas de aplicativo, as quais provocam o surgimento de um novo formato de trabalho que desconsidera muitos dos tradicionais direitos dos indivíduos. Nesse escopo, surge a necessidade de se pensar padrões comuns protetivos ao trabalhador nesse ambiente 4.0, sobressaindo-se a Organização Mundial do Comércio (OMC) e a Organização Internacional do Trabalho (OIT) como potenciais locus.
Objetivos: A presente pesquisa visa analisar a (falta de) regulamentação à nível global do crescente fenômeno da uberização do trabalho, evidenciando, sobretudo, o papel potencial da OMC e da OIT para o desenvolvimento da proteção do trabalhador.
Metodologia: Segue-se o método dedutivo de abordagem para o desenvolvimento do texto, os métodos histórico e descritivo-explicativo de análise de objetivos, e as técnicas bibliográfica e documental de procedimento de pesquisa, selecionadas desde as palavras-chave e utilizando-se de critérios qualitativos.
Resultados: Conclui-se que a cooperação entre elas seria o melhor caminho para o combate às condições laborais dos trabalhadores de plataforma, na medida em que a OMC, de um lado, poderia legitimar sanções econômicas às empresas de aplicativo que violassem os direitos laborais mínimos e, de outro, a OIT poderia exercer a sua regulamentação na domesticidade dos países através da elaboração de uma Convenção ou Recomendação
A América Latina Uberizada: as Plataformas Digitais de Trabalho Aprofundam a Dependência da Região?
The present work aimed to analyze the phenomenon of the uberization of work in Latin America, based on the cases of the companies Uber and 99, from the perspective of the Marxist theory of dependence by Ruy Mauro Marini. To do so, it was based on the assumption that capitalist development in Latin America has its own characteristics, which differ from those found in the world center. Thus, the categories of analysis used in the research were overexploitation of the workforce and economic dependence, based on Marini’s theory of dependence. Therefore, following the hypothetical-deductive method of approach, the descriptive--explanatory objective analysis, and using the bibliographic procedure technique, it was concluded that the overexploitation of the workforce and the dependency condition in Latin America are deepened by platform capitalism

This article aims to understand the functioning of the international system from the observation of the daily life of the Latin American application worker, based on the assumption that the violence that affects him allows the understanding of the injustices inherent to the international structure.
Therefore, following the qualitative methodology of case study, the study will be developed from the hypothetical-deductive method of approach, descriptive-explanatory of objective analysis, and will use the bibliographic and documental techniques of procedure. Thus, based on Thomas Pogge's
concept of Global Justice, and from a critical perspective of international law, especially inspired by Luis Eslava's efforts to observe the local as intrinsically linked to the international, the work concludes that it is possible to analyze the structure of the international system by turning its gaze to the individual – Latin American uberized worker – from four aspects: patriarchy, racism, coloniality and imperialism
Resurrecting the ambo Part 1
The use of the ambo during the celebration of Mass with a congregation was restored to the Roman rite in 1964, it seemed after centuries of absence. Limited use of the ambo during Mass, or remains of the ambo such as lecterns, had continued interrupted in some Western rite contexts from the Council of Trent until the Second Vatican Council. The reception of the ambo from 1964 was rather modest with respect to its monumental history and symbolic wealth. This was due, no doubt, to the significance and history of the ambo going unnoted in Roman documentation and liturgical books in the years after Sacrosanctum Concilium. Renewed emphasis on the significance of the ambo on the part of the Roman dicastery for divine worship appeared in the context of the Roman rite in the late 1980s and once again in the Jubilee year 2000 but seems to have been overlooked in the vast majority of local churches. The author reviews what he considers to be a gradual restoration of the ambo to its medieval heyday while seeing that same restoration as central in placing the celebration of Christ’s paschal mystery at the heart of the liturgy renewed after Vatican II.Używanie ambony w czasie celebracji Mszy w zgromadzeniu zostało przywrócone w rycie rzymskim w 1964 roku, po, jak się wydawało, nieobecności przez wieki. Ograniczone użycie ambony, lub pozostałości ambony takie jak lektorium (pulpit), podczas Mszy zostało jednak utrzymane bez zrywania kontekstu w niektórych rytach zachodnich, od Soboru Trydenckiego aż do Soboru Watykańskiego II.
Postrzeganie ambony od roku 1964 było skromne w porównaniu z jej monumentalną historią i bogactwem symbolicznym. Ta powściągliwość wynikała bez wątpienia z braku adnotacji w dokumentach rzymskich i księgach liturgicznych po "Sacrosanctum Concilium" o znaczeniu i dziejach ambony. Ponowne podkreślenie znaczenia ambony przez rzymską dykasterię ds. Kultu Bożego pojawiło się w kontekście rytu rzymskiego pod koniec lat 80-tych i kolejny raz w roku jubileuszowym 2000, ale wydaje się, że zostało ono przeoczone w większości kościołów lokalnych. Autor opisuje to, co uważa za stopniowe przywracanie ambony do jej średniowiecznej świetności, jednocześnie widząc, że ma ono kluczowe znaczenie dla umieszczenia celebracji misterium paschalnego w centrum liturgii odnowionej po Soborze Watykańskim II
Movimentos latino-americanos de trabalhadores uberizados: uma análise desde abaixo
The present research aimed to analyze the relationship between the social movements of Latin American uberized workers and the possible legislative changes produced in the region. In this sense, it was assumed that, as it is essentially marked by international dependence and the super-exploitation of the workforce, platform capitalism is established with particularities in Latin America. In view of this, the initial hypothesis was that the collective organization of application workers in the region, faced with the regulatory inertia of work on digital platforms, acts in a way to produce legal transformations towards the regulation of their activities, especially because they disproportionately feel the effects of the uberization of work. From the analysis, although the direct relationship between the outbreak of protests and legislative production was not attested, it was possible to confirm the importance of these movements. This is given that, despite having identified the existence of a complex situation, in which several additional factors influence the regulation of the uberization of work, such as political interests, the economic and subjective strength of companies, the dispute of meanings between workers themselves and the clash between the traditional and uberized sectors of the same service, the articulation of workers in these collectives, unions and movements are fundamental for the insertion of regulatory agendas in the legislative scope. With regard to the methodological design, the study was developed following a qualitative methodology, using the deductive method of approach, the descriptive-explanatory objective analysis, and the bibliographic and documentary procedural techniques. Furthermore, its theoretical anchoring was an overlap between Ruy Mauro Marini's Marxist Dependency Theory and the Third World Approaches to International Law (TWAIL) - the latter, focusing, in particular, on Balakrishnan Rajagopal's theory -; furthermore, Beverly Silver's theory served to understand the rise of social movements in the era of platform capitalism
