In the context of the deep changes and ethical solicitations that invest our social and cultural life, also the law appears more sensitive and careful to the needs, vulnerability and even lacks of those who, because of several occurrences in their lives, are exposed to other people's, and also to one’s own fragility. According to this view, the law on shared custody, promoting a different ethical undertaking of public authorities, increases the value of each parent’s responsibility and capability of curing and taking care of their children’s emotional and moral needs, in the difficult situation of couple conflict. The principle of double parenthood is the proposed tool to achieve a model of cooperation not to be intended as the continuity of a family after all its ties have been broken, but as a way to restore and requalify children’s relationships with both their parents. According to the new connotations that the introduction of shared custody has imposed to the management of parents’ responsibility, also a technical advice in the civil procedures of separation and divorce, is aimed at new and dynamic configurations able to solicit to radically rethink all their procedural and methodological finalities. In this new context of double parenthood a technical advice assumes, in fact, the function of mediation and planning of the most suitable interventions to accompany and sustain the transformative run of the family, safeguarding its fondness and emotional resources. Over passing the traditional request to choose the most suitable parent, the 40 • abstract expert investigation is aimed at individualizing and searching the affective, pedagogical and relational resources that all family components are able to provide to promote a harmonic psychophysical development of minors during their developmental transitions. According to this new point of view, which wants to stop making a pathology of separation, the new technical advise is intended to draw functional profiles of parenthood, aimed at promoting a balanced relationship between parents and children, without neglecting the conflictual and emotional context where the expert investigation is sometimes carried out, that, if it is not adequately evaluated in all its specific connotations, can increase tensions and even produce further problems. Furthermore, a better evaluation of intersubjectivity and relational aspects of minors, solicits a more and more complete analysis of the family system as a whole, without neglecting the role of minors, of their interactions, backgrounds and needs as children. Therefore, it is much more necessary than in the past, a full cooperation and interaction among judges, attorneys at law and, still, among all professional bodies involved in the delicate task of the defence of children, finalized to favour parents’ involvement in the educational process and to allow new models of love expression between parents and children. 4

The Care of Vulnerability: The Proposal of an Ethical Space

    No full text
In recent years, the category of vulnerability has increasingly become the subject of attention from ethical, legal, and political reflections. Various events have shown how vulnerability cannot be considered a specific attribute of some individuals or certain segments of the population but belongs to all living beings by virtue of the deep interconnection between human beings and the ecosystem. This need for a relationship with others is precisely what has prompted a revision both of our concept of social responsibility, and of the taking care of the needs of the Other, within a holistic “One Health” vision based on the recognition that human, animal, and ecosystem health are all indissolubly linked. Even in the medical and health care field has emerged a new relational dimension based on the recognition of the constant precariousness of the health-disease balance and the awareness of the connections between the person and the space they inhabit. And it is precisely thanks to this new approach that the homo independens, called to self-affirmation and total autonomy, has given way to the homo curans who, aware of the network of relationships they are part of, reaches out to others, towards an increasing valorization of a generative dimension of solidarity. For this purpose, the authors analyze the proposal put forward by the National Bioethics Committee (NBC) to implement in Italy the so-called “Ethical Space”: a place capable of offering the listening an welcoming of diverse life experiences in a protected relational context, free from the different dynamics of power and subjection, and capable of welcoming the discussion on ethical issues regarding health, giving voice both to health professionals and individual citizens and associations that represent them

Background: The care of patients in the terminal phase of their lives requires a broader approach that encompasses emotional, psychological, relational, and spiritual support for the person. Methodology: This paper describes the “TeatroDiLetto”, a project aimed at exploring the possibility, for terminally ill patients, to express their experiences, stories, and emotions through various artistic forms, with the aim of promoting their emotional and psychological wellbeing and a better quality of care. The project involved three Italian associations dealing with healthcare support and a multidisciplinary group composed of: doctors, bioethicists, psychologists, therapists, and theatre actors. Training sessions were organised for the operators involved in the project, and individual interviews were conducted with all participants, before and after the artistic experience. Results and Discussion: Preliminary results suggest that the valorisation of patients’ narratives, life stories, memories, and wishes can have a significant impact on their well-being and on the quality of the operators’ professional performance, while fostering that sense of community and sharing among all those involved, which is the basis of any authentic care support process as well. Conclusions: Healthcare professionals should be prepared to interact with different humanities professionals, so that they might collaborate in the realisation of a personalised care project that is attentive to: the specific history of each subject, cultivating constant dialogue between knowledges, and drawing on a multiple and interactive panorama of competences

Social perceptions towards animals have, in recent decades, undergone important evolutions, towards a more inclusive view, focused on the recognition of the intrinsic value of all living forms. In this context, pet burial cemeteries are a testament to the human bond with the animal and the intensity of the emotional response that its breaking evokes, as well as an opportunity to reflect on, and improve, our understanding of the evolution of this extraordinary relationship. The most significant cultural and social changes on the subject will be highlighted in this article, through a historical overview of animal burial

Artificial intelligence and the caring relationship: ethical profiles

    No full text
Use of artificial intelligence (AI) in healthcare can offer multiple and discordant contributions. These technologies may enable health workers to reduce the time needed for routine bureaucratic activities, sometimes sterile and distracting regarding the interests of the sick person and allow them to increase the patient’s listening space and willingness to engage in a caring relationship. On the other hand, this automated cognitive assistance may also reduce or undermine the relational skills and abilities of the healthcare staff themselves. For these reasons, the impact of AI on clinical care and the doctor-patient relationship requires careful ethical consideration. There is a need to develop ethical criteria to protect patients’ self-determination, ensuring transparency, equality of opportunity, privacy and safety. Therefore, a primary focus should be on training healthcare personnel in technological, ethical and social issues. In addition, special attention should also be paid to enhancing ethical discussion in the training courses of engineers, computer scientists and developers, with particular reference to the impact of design in the application of technologies on humans. Finally, the authors emphasize the need to foster a growing awareness in the population of the opportunities and risks of new technologies

    No full text
The profound social, ethical and juridical transformations that have invested the condition of childhood have also affected the consideration of the existential interests of the minor in the care relationship and his role in the adoption of the therapeutic choices that concern him. If the history of children's rights is recent, that of children's rights in the health field is still at the outset. The legal status of the minor in the medical field expresses all the complexity of a status that, for a long time, has been subject to profound reconsiderations and which concerns various and different stages of growth and the formation of his personality. The participation of the child is an important factor to condition the therapeutic path and improve the curative results. However, the participation of the minor in his/her health path still has obstacles and shortcomings. The promotion of a specific communicative competence of health professionals can represent an important factor capable of contributing to the growing autonomy of the child and positively influencing the therapeutic path

Several new alternatives to traditional burial have emerged through the years, including the communal cinerary urn option which involves the cremation of the deceased and the burial of their ashes in a shared burial, often located in a dedicated site, such as a memorial garden or a cemetery. Understanding the motivations and ethical considerations, that guide people’s burial choices can offer valuable insights for both practitioners and those who are faced with making decisions regarding their own burial, or that of their loved ones. This study aims to examine funeral rites and the concept of the communal cinerary urn exploring, through interviews conducted with family members of people who have chosen this option, the personal, cultural, economic, and spiritual motivations that led them to opt for this form of burial, while also analysing the ethical concerns and emotions associated with this choice, including feelings of loss, respect, and remembrance
