No full text4926 Sayılı Kaçakçılıkla Mücadele Kanunu Kapsamında Gümrük Kaçakçılığı Suçları olarak adlandırdığımız bu tez çalışmasında, öncelikle 19.07.2003 tarih 25173 sayılı resmi gazetede yayınlanarak yürürlüğe giren 4926 Sayılı Kaçakçılıkla Mücadele Kanunu kapsamında yer alan kavramlarla birlikte gümrük kaçakçılığı suçunun tanımı, tarihçesi ve diğer kaçakçılık suçlarından farkı açıklanmaya çalışılmıştır. İkinci bölümde ise, 4926 sayılı kanunun 3'üncü maddesinde dokuz bent halinde düzenlenmiş olan ithalat(giriş) kaçakçılığı suçları ile ihracat(çıkış) kaçakçılığı suçlarının her biri ayrı ayrı incelenmiş olup, bu inceleme kapsamında suçun unsurları, faili, özel görünüş şekilleri ve bu kaçakçılık suçlarının gerçekleşmesi halinde uygulanacak yaptırımların neler olduğu ele alınmıştır. Ayrıca 26/ 09/ 2004 tarihli 5237 sayılı Yeni Türk Ceza Kanunu'nun genel hükümler bölümünde yer alan suça teşebbüs, suça iştirak ve içtima hükümleri ile yaptırımların türleri ve tüzel kişilerin ceza sorumluluğu gibi müesseselerin nasıl düzenlenmiş olduğu belirtildikten sonra, 4926 sayılı Kaçakçılıkla Mücadele Kanunu'nun 3'üncü maddesinde düzenlenmiş olan kaçakçılık suçlarının 5237 sayılı Yeni Türk Ceza Kanunu'nun genel hükümlerine aykırılık teşkil eden düzenlemeleri belirtilmiştir. Çalışmanın son bölümünde ise, tüm bu açıklamaların yanında, ayrıca 4926 sayılı Kaçakçılıkla Mücadele Kanunu'nun 3'üncü maddesinde dokuz bent halinde düzenlenmiş olan kaçakçılık suçlarının hem 1918 sayılı Kaçakçılığın Men ve Takibine Dair mülga kanuna göre hem de 5237 sayılı Yeni Türk Ceza Kanununa göre değerlendirilmesi yapılmıştır. As we named in this thesis task, Smuggling Crimes Defined İn State Number 4926 Challenging With Smuggling Law, Previously, we have to highlight that, State Number 4926 Challenging With Smuggling Law to become valid by official gazzette which is numbered 25173 and published in 19.07.2003. Subseguently, This thesis task contains the official gazette's concept such as the definition of smuggling, the history of smuggling and the differences between the smuggling crimes and the other smuggling crimes. İn the second part, important smuggling crimes and exporting smuggling crimes, which take place in state number 4926, third article as nine dam of law, are abserved. By the help of this abservation, the companant of the crimes, the perpetrators, differnt types, what shall be done if smuggling occurs are answer gues tions. Attempting the crime, participating, the crime, responsibility of legal entities which is in the numbered 5237 and published in 26/ 09/ 2004 The New Turkish criminal Code, topic's made clean morever, the disagrement between The New Turkish Criminal Code Law and State Number 4926 Challenging With Smuggling Law's third article's are hightlighted. İn the last part of the thesis task includes the smuggling crimes which are organized as state number 4926, third article as nine dam of law, are ewaluated according to state number 5237 in the New Turkish criminal Code Law and state number 1918 in smuggilng law
