Get PDFΔιπλωματική εργασία--Πανεπιστήμιο Μακεδονίας, Θεσσαλονίκη, 2025.Σκοπός της παρούσης εργασίας είναι η παρουσίαση της ποινικής προστασίας των προσωπικών δεδομένων με τον Ν. 4624/2019. Η διεθνής έννομη τάξη με την Ευρωπαϊκή Σύμβαση των Δικαιωμάτων του Ανθρώπου, τον Χάρτη των Θεμελιωδών Δικαιωμάτων του Ανθρώπου και τον Κανονισμό 679/2016 έσπευσε να προστατεύσει τα δεδομένα προσωπικού χαρακτήρα. Η Ελλάδα αρχικά με τον Ν. 2472/1997, εν συνεχεία με το άρθρο 9 Α Συντ. και τώρα με τον Ν. 4624/2019 κατοχυρώνει, οριοθετεί και προστατεύει από κακόβουλες επιθέσεις το δικαίωμα του πληροφοριακού αυτοκαθορισμού του υποκειμένου των προσωπικών δεδομένων. Ειδικότερα, στις πέντε πρώτες παραγράφους του άρθρου 38 Ν. 4624/2019 τυποποιούνται ως ποινικά αδικήματα πράξεις παρέμβασης, διαχείρισης και διάχυσης δεδομένων προσωπικού χαρακτήρα και ειδικών κατηγοριών, καθώς και τέτοιες πράξεις που συνδέονται με οικονομικό όφελος ή προκαλούν κίνδυνο για το δημοκρατικό πολίτευμα ή την εθνική ασφάλεια. Ο χώρος, όπου μπορούν να διαπραχθούν τα παραπάνω εγκλήματα, αποτελεί θέμα ενδιαφέροντος λόγω της δυνατότητας διαδικτυακής δραστηριότητας των δραστών. Τα αδικήματα του άρθρου 38 Ν. 4624/2019, ανάλογα με την ποινική τους απαξία, είναι πλημμελήματα ή κακουργήματα, μερικά δε εξ αυτών περιέχουν ρήτρες επικουρικότητας, οπότε πρέπει να αναζητείται ανά περίπτωση εάν διεκδικεί εφαρμογής κάποια άλλη διάταξη. Περαιτέρω, διώκονται αυτεπαγγέλτως, μπορούν να τελεστούν σε απόπειρα και με συμμετοχή, είναι δυνατή η παράσταση του θύματος – υποκειμένου των προσωπικών δεδομένων προς υποστήριξη της κατηγορίας. Τέλος, ενδιαφέρον παρουσιάζει η αντιμετώπιση περιπτώσεων, κατά τις οποίες η ίδια παραβατική συμπεριφορά απειλεί και ποινική και διοικητική κύρωση, καθόσον πρέπει να εξετάζεται η αρχή ne bis in idem. Οι τελικές παρατηρήσεις αφορούν σε ζητήματα νομοτυπικής μορφής των ως άνω αδικημάτων, τα οποία προκαλούν διχογνωμία και, ως εκ τούτου, καλό θα ήταν να αντιμετωπιστούν νομοθετικά
Two radio-emission mechanisms in PSR J0901-4624
No full text© 2015. The American Astronomical Society. All rights reserved. We have detected sporadic, bright, short-duration radio pulses from PSR J0901-4624. These pulses are emitted simultaneously with persistent, periodic emission that dominates the flux density when averaging over many periods of the pulsar. The bright pulses have energies that are consistent with a power-law distribution. The integrated profile of PSR J0901-4624 is highly polarized and shows four distinct components. The bright pulses appear to originate near the magnetic pole of the pulsar and have polarization properties unlike those of the underlying emission at the same pulse phase. We conclude that the bright pulses represent a secondary giant-micropulse emission process, possibly from a different region in the pulsar magnetosphere
