En el presente informe se analiza la Resolución N° 2615-2024-TCE-S6 del Tribunal de
Contrataciones del Estado, que declaró fundada la apelación del Consorcio BDG Life and
Health. El comité de selección no cumplió con lo ordenado en la Resolución N° 2242-
2024-TCE-S4, que ordenó la subsanación de foliación de la “Carta de cumplimiento de
especificaciones técnicas”. En consecuencia, el Tribunal declaro válida la oferta, dejó sin
efecto la declaración de desierto y otorgó la buena pro al consorcio apelante. El consorcio
participó en la adjudicación de S/ 472,500.00 convocada por el INCOR-EsSalud para el
suministro de prótesis valvulares aórticas percutáneas. El consorcio interpuso cuatro
apelaciones, destacando la última resolución N° 2615-2024-TCE-S6.This report analyzes Resolution No. 2615-2024-TCE-S6 of the State Procurement Court, which declared the appeal of the BDG Life and Health Consortium well-founded. The selection committee failed to comply with Resolution No. 2242-2024-TCE-S4, which ordered the correction of the pagination of the "Letter of Compliance with Technical Specifications." Consequently, the Court declared the bid valid, rescinded the declaration of voidness, and awarded the contract to the appellant consortium. The consortium participated in the S/ 472,500.00 tender issued by INCOR-EsSalud for the supply of percutaneous aortic valve prostheses.
